Privacy Policy

This Privacy Policy describes how Doctronic, Inc. ("we", "us", "our") collects, uses and discloses information about you when you use our services (including our AI-powered medical platform), website (https://www.doctronic.ai/), applications, tools and features, or otherwise interact with us (collectively, the "Services"). To help you better understand our services, and to which services this Privacy Policy applies, please see below.

  • Doctronic, Inc. ("Doctronic"): Doctronic provides an AI-powered platform designed to help people better understand their health. Through our AI technology, users can explore symptoms, ask health-related questions, and receive personalized, easy-to-understand health information and action plans, available 24/7. This Privacy Policy applies to personal information processed by Doctronic. Additionally, depending on where you live, Doctronic may process your consumer health data subject to the Washington My Health My Data Act, the Nevada Health Privacy Act, and similar U.S. laws governing consumer health data. This Privacy Policy does not apply to consumer health data subject to these laws. For more information on how we process consumer health data, please see our Consumer Health Data Privacy Policy.

  • Doctronic Physicians Group, P.C.; Doctronic Physicians Group KS, P.A.; Doctronic Physicians Group WY, P.C.; Doctronic Physicians Group, P.A.; Doctronic Physicians Group NJ Professional Corporation; Summer Health Medical Group, P.A.; J.M. Medical Practice, P.C. (collectively, "DPG"): For users who want to speak to a licensed physician, we offer access to DPG who engages licensed physicians for video visits, prescription support, and other clinical services, which DPG and those physicians provide directly to you. When DPG bills third party payors for your healthcare services, DPG is acting as a "covered entity" for purposes of the Health Insurance Portability and Accountability Act, as amended ("HIPAA") and therefore the "protected health information" that is processed by DPG and its physicians is governed by the HIPAA Notice of Privacy Practices.

Please read this Privacy Policy carefully. By using any of the Services, you agree to the collection, use and disclosure of your information as described in this Privacy Policy. If you do not understand or agree to this Privacy Policy, please do not use or access the Services.

CHANGES TO THIS PRIVACY POLICY

We may modify this Privacy Policy from time to time, in which case we will update the "Last Updated" date at the top of this Privacy Policy. If we make material changes to how we use or disclose information we collect, we will use reasonable efforts to notify you (such as by emailing you at the last email address you provided us or by posting notice of such changes on the Services) and will take additional steps as required by applicable law. If you do not agree to any updates to this Privacy Policy, please do not continue using or accessing the Services.

COLLECTION AND USE OF INFORMATION

When you use or access the Services, we collect certain categories of information about you from a variety of sources. In addition to the specific uses discussed below, we may use this information to provide and improve the Services and to maintain our business relationship, including by enhancing the safety and security of our Services, providing customer support, complying with applicable legal obligations, enforcing any applicable terms of service and protecting our rights and the rights of our employees, users or other individuals.

Information You Provide to Us

Some features of the Services may require you to directly provide certain information, including information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you directly submit through our Services includes:

  • Contact information, such as your name, date of birth, address, sex, and gender, phone number and email address. We use this information to create and maintain your account and provide the Services, and to communicate with you (including treatment-related communications).

  • Account information, such as username and password. We use this information to provide the Services and to create, maintain and secure your account with us. If you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. If you believe your account has been compromised, please contact us immediately.

  • Health information, such as information about your symptoms, health concerns, medical history, and other health-related information.

  • Payment and subscription information, such as bank account, credit or debit card information and billing address, which is collected on our behalf by our payment processor and information about your subscription tier and transaction history. We use this information to process your payment and provide the Services and to provide you with different account features and options.

  • Applicant details, such as information included in your resume or CV, references, and job history. We use applicant details to process your application for employment and to evaluate your candidacy.

  • Any information you choose to input into our AI-powered medical platform ("Input"), which we use to generate and output new information or content ("Output") as a part of the Services. You choose what information to include in Input, including health information, as noted above. We do not use Input or Output to train or fine-tune AI models that power our AI-powered medical platform.

  • Any other information you choose to provide us or otherwise include in communications with us, for example, when sending a message through the Services.

Information Collected Automatically

We and third parties also automatically collect certain information about your interactions with the Services, including through cookies, pixels or other tracking technologies ("Tracking Technologies"). This information is collected and used to tailor your experience with the Services, provide you with offers or promotions, run analytics, measure advertising and marketing attribution, and better understand user interactions with the Services. Such information includes:

  • Device information, such as device type, operating system, and internet protocol (IP) address.

  • Location information, such as approximate location based on IP address.

  • Other information regarding your interaction with the Services, such as browser type, log data, date and time stamps, interactions with marketing emails and ad impressions.

Information Collected from Other Sources

We may obtain information about you from outside sources, including information that we collect directly from third parties and information from third parties that you choose to share with us. Such information includes:

  • Information we receive when you choose to access the Services through your email account or link any social media platforms to your account, such as Google, Facebook or Apple, which we use to maintain your account and login information. These partners provide information such as your name, email address and additional account information that is publicly available.

  • Health-related information we receive from third-party sources, such as Apple HealthKit data (such as heart rate, blood pressure, sleep activity). Please note that we may also receive information, including prescription history and medical records - to the extent such information is received and processed by DPG, such information may be PHI which is not subject to this Privacy Policy.

  • Information from identity verification providers.

Any information we receive from outside sources will be treated in accordance with this Privacy Policy. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. Deidentified Information

Finally, we may deidentify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you ("de-identified information") (or we may collect information that has already been de-identified/anonymized), and we may use de-identified information for any purpose, not including information collected via the Utah Renewal Service, as described in our Terms of Service. To the extent we possess or process any de-identified information, we will maintain and use such information in de-identified form and not attempt to re-identify the information, except for the purpose of determining whether our de-identification process satisfies legal requirements.

COOKIES AND OTHER TRACKING TECHNOLOGIES

As described above, we and third parties use Tracking Technologies to collect certain information about your interactions with the Services. Most browsers accept Tracking Technologies automatically, but you may be able to control the way in which your devices permit the use of certain Tracking Technologies. If you so choose, you may block or delete certain Tracking Technologies from your browser; however, blocking or deleting cookies may cause some of the Services, including login features and general functionality, to work incorrectly.

Your browser settings may allow you to transmit a signal or other mechanism for exercising your choice regarding the collection or processing of your information when you visit various websites.

Depending on where you live, you may have the right to opt out of targeted advertising through a Global Privacy Control (GPC) enabled browser setting. If you have this right, we will treat our initial receipt of the GPC signal as a valid request to opt out of targeted advertising. If you are logged out, our processing of the signal will be limited to the browser that you are using.

DISCLOSURE OF YOUR INFORMATION

We may disclose your information for legitimate purposes subject to this Privacy Policy, including:

  • Vendors or other service providers who help us provide the Services including for system administration, identity verification, cloud storage, security, customer relationship management, marketing communications, analytics, payment networks, payment processing and the deployment of Tracking Technologies.

  • Healthcare providers and family members that you authorize.

  • Our affiliates or others within our corporate group.

  • Professional advisors, such as auditors, law firms or accounting firms.

  • Third parties in connection with or anticipation of an asset sale, merger, acquisition, or other business transaction, including in the context of a bankruptcy proceeding or other restructuring matter.

  • For legal and security reasons and to protect our services and business, including to cooperate with law enforcement, judicial orders and regulatory inquiries, to detect and prevent against fraudulent or illegal activity, to exercise or defend legal claims and to ensure the safety and security of our business, employees and users, and to enforce our terms or other agreements.

  • Other third parties with your consent or at your direction.

While we do not sell personal information in the traditional sense, we disclose (and have disclosed in the preceding 12 months) the following categories of personal information for marketing and advertising attribution purposes with providers of Tracking Technologies in a manner that may be considered "selling" or "sharing" as those terms are defined under applicable law: identifiers and internet or other similar network activity. We do not disclose health information in this manner. However, we have no actual knowledge that we have "sold" or "shared" the personal information of individuals under 16 years of age.

THIRD-PARTY WEBSITES AND MATERIALS

We may provide links to third-party websites or platforms and display or make available content, data, applications or materials from third parties. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies and other terms. We are not responsible for the privacy or security of, or information found on, these sites or platforms, or the accuracy, completeness or reliability of third-party materials. Information you provide on public or semi-public venues, such as third-party social networking platforms, may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

MINORS' PRIVACY

Our Services are not intended for minors, and we do not seek or knowingly collect any personal information about individuals under the age of 18. If we become aware that we have unknowingly collected information about an individual under the age of 18, we will make commercially reasonable efforts to delete such information from our database. If you are the parent or guardian of an individual under 18 years of age who has provided us with their personal information, you may contact us using the below information to request that it be deleted.

DATA SECURITY AND RETENTION

We have implemented commercially reasonable security measures designed to protect your personal information from unauthorized access, use or disclosure. However despite our efforts to protect your information, no security measures are impenetrable, and we cannot guarantee "perfect security." Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

We retain your information for as long as is reasonably necessary for the purposes specified in this Privacy Policy. When determining the length of time to retain your information, we consider various criteria, including whether we need the information to continue to provide you the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity or protect ourselves, including our rights, property or products.

PRIVACY RIGHTS

Depending on where you live, you may have certain rights in relation to your personal information. However, please note that a number of these rights only apply in certain circumstances, and all of these rights may be limited by law.

  • Access / Know: You may have the right to request access to the personal information we hold about you and to obtain details about what personal information we have collected about you, including the categories of personal information, the categories of sources from which the information was collected, the business or commercial purposes for collecting, selling or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you. You may also request to obtain a list of specific third parties, other than natural persons, to which we have disclosed your personal information.

  • Deletion: You may have the right to request that we delete personal information we hold about you.

  • Correction: You may have the right to request that we correct inaccurate personal information we hold about you.

  • Portability: You may have the right to receive a copy of the personal information we hold about you in a portable and, to the extent technically feasible, readily usable format.

  • Opt-Out of Marketing: You may opt out of marketing at any time by using the unsubscribe / opt-out instructions provided in our communications to you. If you opt out, we may still send you transactional or administrative messages, such as emails about your account.

  • Opt out of Sale or Sharing/Processing for Targeted Advertising: You may have a right to direct us not to sell your personal information, or share or process your personal information for targeted advertising.   • Opt out of Automated Decision-Making or Profiling: You may have the right to opt out of the processing of your information for the purposes of certain types of automated decision-making about you and/or the profiling of your information in furtherance of decisions that produce legal or similarly significant effects, or to request human review of, express your views on or contest the outcomes of automated decision-making (as all such terms and concepts are defined under applicable law).

Submitting a Request

We will not retaliate or discriminate against you for exercising any of these rights. Further information may be needed to verify your identity before exercising these rights, such as your email address or government issued ID. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. If we deny your request, you may have the right to appeal our decision by contacting us through the methods described in the section below, How to Contact Us.

When you submit a request or launch an appeal, we will limit our collection of your information to only what is necessary to securely fulfil your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal.

CALIFORNIA RESIDENTS

This section applies to you if you are a resident of California and we process personal information about you that is subject to the California Consumer Privacy Act ("CCPA"). For purposes of this section, references to "personal information" shall include "sensitive personal information" as defined under the CCPA.

Processing of Personal Information

In the preceding 12 months, we collected and disclosed to service providers (as described in the Disclosure of your Information section above) the following categories of personal information and sensitive personal information (denoted by *):

  • Identifiers, such as name, e-mail address, IP address

  • Personal information categories listed in the California Customer Records statute such as name, physical characteristics or description, address, telephone number, driver's license* or state identification card number*

  • Characteristics of protected classifications under California or federal law such as sex (including gender, pregnancy, sexual orientation*, and gender identity*), age, physical or mental disability

  • Commercial information such as records of products or services purchased

  • Internet or other similar network activity such as information regarding your interaction with the Services

  • Geolocation data such as general location derived from your IP address

  • Audio, electronic, visual, or similar information such as photographs, video recordings and voice recordings

  • Professional or employment-related information such as title of profession, employer, professional background

  • Inferences drawn from other personal information such as a profile reflecting your preferences

  • Government identifiers* such as a driver's license, state identification card, or passport number

  • Account access credentials* such as account log-in

  • Racial or ethnic origin*

  • Personal information concerning an individual's health*

  • Personal information concerning an individual's sex life or sexual orientation*

The categories of sources from which we collect your personal information and the specific purposes for which we collect and disclose (including "selling" and/or "sharing") your personal information, are described in the sections above, Collection and Use of Information and Disclosure of Your Information, respectively.

We only use and disclose sensitive personal information for purposes specified in the CCPA or otherwise in line with your consent, and we do not use or disclose sensitive personal information for purposes of inferring characteristics about you.
